[000.0-004.2] So this is actually not true and everybody in BC needs to be aware of this. [004.2-008.3] I went through 30 different law firms trying to get a lawyer and all of them said [008.3-013.4] they would love to take my case, they would love to help me, but they literally can't [013.4-018.6] because the way that the legislation is done now, ICBC is just invincible pretty much. [018.6-024.1] If you get in an accident and it's somebody else's fault and ICBC has determined that [024.1-030.1] it's somebody else's fault, you can't sue. Like in any shape or form you cannot sue the person. [030.1-036.8] They've made the legislation this way by the way. In my situation ICBC called literally the next day [036.8-042.5] was like, hey the driver had a dash cam, we have the footage, we saw it, you can't have it, [043.0-050.1] and he was definitely distracted driving and he's 100% at fault, but we are now in no fault insurance [050.2-055.0] and there's nothing else that you can do about it. The only time you can sue a driver is if they were [055.0-063.1] criminally charged at the time for a crime and the police filed that ticket or whatever at the scene. [063.1-067.9] So if somebody's driving recklessly, if someone is not paying attention to the road, if they're on [067.9-074.3] the phone, anything like that, it doesn't matter. Like you just they're exempt from being sued. [074.3-080.9] Every time any person in BC is getting into their car on the road, they are at risk because [080.9-090.6] your insurance company, the one that has a monopoly and is government regulated, it's not going to protect you.
